New York executive files $60 million libel lawsuit over insurance scandal

Tuesday, August 23, 2011

A former Marsh & McLennan Cos. executive has hit former New York Governor Eliot Spitzer with a $60 million defamation lawsuit over an online magazine article regarding an insurance bid-rigging scandal.

William Gilman, a former Marsh managing director, filed a complaint last Friday in the U.S. District Court in Manhattan, over allegations Mr. Spitzer defamed him in a Slate article published a year ago. A copy of the complaint was made public on Monday.

Gilman, who had a final insurance fraud charge dismissed in January, said Spitzer acted with “actual malice” by suggesting that he was guilty of crimes of which he was never accused.

Although he wasn’t named in the article, Mr. Gilman complained that Spitzer defamed him by writing that “Marsh’s behavior was a blatant abuse of law and market power: price-fixing, bid-rigging and kickbacks all designed to harm their customers and the market while Marsh and its employees pocketed the increased fees and kickbacks.”

“While Mr. Spitzer’s statements do not refer to Mr. Gilman by name, Mr. Gilman is readily identifiable as the subject of the defamatory comments,” said the complaint. “Mr. Spitzer was well aware of his own allegations as attorney general and the resolution of those allegations in favor of Mr. Gilman and yet, recklessly disregarded these facts.”

In 2004 Mr. Spizter, then the state’s Attorney General, announced an investigation into the practices at Marsh & McLennan, particularly fees paid by insures to brokers who place business with them. Gilman, who worked for the company at the time, was charged in 2005 with 37 counts of insurance fraud. Gilman’s final charge was dropped last January.

“I haven’t seen the lawsuit and so will not comment on it,” said Spitzer. “The illegalities rampant at Marsh & McLennan leading to their fine of $850 million and the multiple judicial findings of illegality are clear from the public record.”

Mr. Gilman is now seeking at least $10 million in compensatory damages; $20 million in general damages, including damage to his reputation; and $30 million in punitive damages.

Understand The Health Insurance Subsidy

Submitted by: Dennis Jarvis

The whole health subsidy change is new to American and most people. There are many questions on how it works and whether a person is eligible. Your answers are below! Keep in mind that the health reform bill which created the health subsidies is 1000’s of pages….none of them easy or fun to read. Our goal at

HealthSubsidy.net

is to take all that information and simplify it so that real people can understand their options. A quick lay of the land. On this page, we’ll hit the big ticket items that touch on the health subsidy universe with links to additional detail on each topic. Let’s get into it!

Eligibility

In general, the subsidy will be available for individuals and families (not through group health insurance) who are citizens of the United States. There are three important considerations to look at in terms of eligibility. There other constraints and rules (it was a product of Congress after all) but these are the big three.

Up to 400% of the Federal Poverty Level

The subsidies are designed to help people afford health insurance for those that make up to 400% of the Federal Poverty Level. You can access those numbers here and the qualification will have a look back period. For example, 2013 income will drive 2014 eligibility. Below between 133% and 150% of the FPL, you may qualify for no cost Medicaid depending on your State. From that baseline up to 400% of the FPL, you will likely be eligible for a health subsidy. Above 400% of poverty, there will be NO subsidy. More detail on the 400% Rule

How much Health Subsidy can you Expect

9.5% of your income becomes a factor

So let’s say you qualify based on the 400% Rule of the FPL? How much will you receive. There’s two considerations here. First, how much is the underlying health insurance plan premium itself. This is driven by your age, area, and family make up. The second factor is the 9.5% Rule. Basically, the law states that you shouldn’t have to pay more than 9.5% of your MAGI (Marginal Adjusted Gross Income) towards health insurance. For example, if you make $1000 monthly in MAGI, your health insurance shouldn’t be more than $95/monthly. If your health insurance is $400/monthly, your expected subsidy would be $305/monthly or more than $3600 annually. We recommend using our Health Subsidy Calculator (props out to Kaiser Foundation) for an estimate and the Health Subsidy Quoting page will show actual numbers starting Oct 1st 2013.

How will the health subsidy actually work

Keep in mind that there may be differences by State but the health subsidy is expected to process this way. You will run your quote through our Partner (eff Oct 1st 2013). Part of this process will ask for income information. The system will automatically determine whether you qualify for a health subsidy and show the net premium by plan. You can then apply for coverage right through our Quoting partner and you will only pay the net difference. The health subsidy is all handled automatically starting the first month that you actually have the coverage. There may be some tax time considerations if your income increased or dropped significantly (the 400% and 9.5% rule above) but the process is fairly automated. That’s great news!

Which plans can you enroll in with the Subsidy

The health subsidy will be based on the Silver Metallic plan (see Health Exchange plans and Metallic plans). Each State will have different options to qualify with the subsidy which you can find in our Health Subsidy Quote page when the Exchange is live (Oct 1st 2013). If you qualify for a subsidy, there will be very little reason not to get a qualified Exchange plan. If you do not qualify for a subsidy, you’re best options will likely be off the Exchange or to keep your Grandfathered plan (a plan unchanged with effective date prior to 10/23/2010). More detail on Exchange Plans and Grandfathered Plans.

Hundreds of thousands of British public sector workers strike over planned pension changes

Friday, July 1, 2011

Hundreds of thousands of British public sector workers went on strike across the country yesterday to protest planned changes to pensions. As industrial action swept the country, half of all schools were hit when teachers walked out, thousands of emergency service responders did not arrive at work, and there were warnings of immigration delays at Heathrow airport.

Police arrested 26 people as protesters picketed on a march in London, and riot police kettled demonstrators as clashes broke out. Reports vary, but it is thought that up to half of British state schools have been affected as employees did not turn up to work.

Mark Serwotka, the leader of the Public and Commercial Services Union (PCS), said the strikes would serve as a “wake-up call” to the coalition government. “It’s a very, very clear signal to the government that they have been rumbled,” Serwotka said. “This is not about pensions, this is about making public sector workers pay for the economic problems, and we are determined to keep going until they change direction.”

Government officials condemned the strike and said the planned changes to pensions, which would see teachers work until age 68 and get less from their pensions, were “fair to taxpayers” as Britain attempts to deal with a large budget deficit. A spokesperson for Downing Street insisted the strike was having a “minimal” impact and said the turnout suggested many public sector workers supported the pension changes.

Christine Blower, the general secretary of one of the striking unions, the National Union of Teachers (NUT), said the strike demonstrated “the anger and distress that this government is causing teachers.” She said the “unjustified attacks” on the pensions of teachers “are nothing short of disgraceful.” Speaking on BBC television programme Question Time, she added: “Much of this has already been imposed on teachers without negotiation, and when we say there are talks going on it’s perfectly true that the government is talking but it isn’t actually listening.”

But despite government claims that the strike was having little impact, 5,679 schools were closed and another 4,999 were affected as teachers did not turn up for work. Michael Gove, the education secretary attacked the walkouts as “disappointing and unnecessary”. Thousands of staff handling emergency 999 calls also striked and pickets were held outside courts as members of the PCS walked out in protest.

This is not about pensions, this is about making public sector workers pay for the economic problems, and we are determined to keep going until they change direction.

Francis Maude, the cabinet office minister, also maintained that the strikes were wrong and said the low number of people walking out showed many supported the government’s plans. “What today has shown is that the vast majority of hard-working public sector employees do not support today’s premature strike and have come into work today,” he said.

Senior Labour party figures including Ed Miliband, Tessa Jowell and John Denham said the strikes were unjustified until negotiations with the government had concluded. Mary Bousted of the NUT criticised Labour’s lack of support for the striking workers: “The response of Ed Miliband has been a disgrace – he should be ashamed of himself. If our strike is a mistake, what has he done to oppose this devastating attack on our pensions? If the opposition will not defend our pensions, we will.”

A largely peaceful march by 30,000 protesters took place through London, and the atmosphere was reported to be largely peaceful, but Metropolitan Police officials said 26 people had been arrested. At a meeting in Westminister, many left wing figures attacked the government plans. Ken Livingstone, a former mayor of London who is running for the job again next year, said the coalition government had “mishandled” the issue of pensions. “The government must end its attacks and negotiate on the core issues under contention,” he added.

Thousands of Australian workers set to rally against IR reform

Tuesday, November 15, 2005

Police and union leaders across the country expect big crowds during today’s National Community Day of protest against the Federal Government’s WorkChoices proposed changes to industrial relations laws.

The Australian Council of Trade Unions (ACTU) predicts hundreds of thousands of people will demonstrate in Sydney and Melbourne. Protest meetings in other capital cities are expected to attract workers in their tens of thousands. The rallies will take place in 300 regional sites across Australia.

Labor’s opposition spokesman on industrial relations, Stephen Smith says, “The more people become aware of the nature of the changes and the detail of the changes, the more they realise how vulnerable they are and the more they want to do something to prevent the changes.”

Mark Bethwaite, from Australian Business Ltd, believes most people will go to work as usual. “Because frankly they are not convinced by the scare campaign the ACTU has been running,” Mr Bethwaite said.

The Federal Government has been accused of instructing agencies to refuse staff leave to attend the rallies against its IR changes and says it will not be affected by a rally of one person or a 100,000.

The Federal Department of Workplace Relations has issued advice to other departments that employees wanting to attend the National Community Day of Protest should be denied leave.

State and territory leaders intend to mount a High Court challenge to the Federal Government’s proposed industrial relations changes.

The ACTU say, “the IR changes are not just an attack on workers – they fundamentally undermine the values that make Australia great. Beneath all the glossy advertising are proposals that will unfairly curtail your rights at work, cut the amount of time you can spend with family, and erode your job security.”

The federal government have spent over fifty million dollars on promoting the radical new changes.

Unions say the changes will make it easier for workers to be sacked; cut take-home pay and reduce minimum standards; change the way minimum wages are set to make them lower; replace the award safety net with just five minimum conditions; restrict access to unions; make it harder for employees to bargain as a group; and reduce the powers of the independent Industrial Relations Commission.”

In Melbourne, Australian Education Union’s Mary Bluett said the IR legislation “is not the legacy we want to leave our children.” About 12,000 public servants, 10,000 building workers and hundreds of nurses are also expected to join the protest, but workers operating road, train, tram and bus services will remain on duty to allow commuters to travel free to the rally.

Sky News estimated the number attending the rally in Melbourne as 175,000.

The Australian Chamber of Commerce and Industry labelled the rally “a tired union stunt”.
