Colleges offering admission to displaced New Orleans students/OH-WY

Due to the damage by Hurricane Katrina and subsequent flooding, a number of colleges and universities in the New Orleans metropolitan area will not be able to hold classes for the fall 2005 semester. It is estimated that 75,000 to 100,000 students have been displaced. [1]. In response, institutions across the United States and Canada are offering late registration for displaced students so that their academic progress is not unduly delayed. Some are offering free or reduced admission to displaced students. At some universities, especially state universities, this offer is limited to residents of the area.

British teacher faces 40 lashes over teddy bear’s name

A British teacher working in Sudan was arrested on Sunday after parents allegedly complained that she had insulted Islam by naming a teddy bear Muhammad. She faces a possible six months in prison, 40 lashes, or a fine.

Gillian Gibbons, 54, who had arrived at Khartoum’s Unity High School in August, polled the six and seven year old children in her class on what they should call the bear. Out of 8 names, including Abdullah and Hassan, the children overwhelmingly voted for Muhammad, by 20 votes to 3.

The bear was named back in September, as part of a teaching assignment. Each weekend a child would take it home, and write a diary of what they had done with the bear. These accounts were collected in a book with a picture of the teddy on the front, along with the message “My name is Muhammad”. The bear itself was not labeled or marked with the name.

On Sunday, November 25, as a group of angry men chanted threats, the police arrested Ms Gibbons at her lodgings in the School. The book has also been seized, and police want to question the bear’s 7 year old owner.

Since her arrest she has been moved from a local police station to Sudan’s Criminal Investigation Department headquarters for interrogation. British consular officials were initially refused permission to see her, but were allowed to leave food and water. Colleagues from the school have however been able to visit, and consular access was eventually provided.

The British embassy in Khartoum has not been able to confirm whether the teacher has formally been charged.

Director Robert Boulos has closed the school until January for fear of reprisals. “This is a very sensitive issue,” he said.

He stressed that there was no deliberate insult: “This was a completely innocent mistake. Miss Gibbons would have never wanted to insult Islam.” Mr Boulos was also confident she would not face a jail sentence.

However, in an Arabic statement sent to More4 News last night, Unity High School announced that Mrs Gibbons’ employment with the school was being terminated with immediate effect:

“The administration of Unity High School would like to proffer an official apology to all students and their families and to all Muslims for what was an individual action, which does not represent the sentiments of the administration or the school.”

The Sudanese Media Centre, which is linked to the government, reports that that Ms Gibbons’ actions had “met with wide condemnation by guardians of the students”, but colleagues of Ms Gibbons claimed that no such complaints had been received by any of the children’s parents.

Sudan’s Justice Minister, Mohammed Ali Mardhi, ordered General Prosecutor Salaheddin Abu Zaid to take personal charge of the case.

If charged with insulting the Prophet Muhammad, regarded as blasphemy under Sudan’s Sharia law, Ms Gibbons faces 40 lashes or six month’s imprisonment – but the prosecutor has suggested that more serious charges could follow. He is continuing to question witnesses, and there are unconfirmed reports that blasphemy charges have already been brought, and that charges of sedition are being considered.

The British Prime Minister, Gordon Brown, expressed sorrow about what has happened to Ms Gibbons, and stated that contacts had been made with the Sudanese government and police to “clarify” the situation.

Louise Ellman, Labour MP for Liverpool Riverside, called for the release of Ms Gibbons, stating: “I hope that the Foreign Office will do everything they can to calm the situation. I will be giving every assistance I can.”

Dr Muhammad Abdul Bari, of the Muslim Council of Britain, said that Ms Gibbons should never have been arrested in the first place, and called on the Sudanese government to intervene in the case with a view to ensuring that she is released without delay.

In contrast to official statements within Sudan, the Sudanese Embassy in the UK has downplayed the whole affair, saying that the “minute” issue would soon be resolved.

Some commentators have suggested other contributing factors in this furore:

  • Britain’s criticism of the Sudanese government’s human rights record in Darfur may have angered the Sudanese authorities.
  • Teachers at the school have suggested that a colleague with a grudge against the school, rather than parents, might be the source for the complaints.
  • Bishop Ezekiel Kondo, chairman of the school council, suggested that the affair could be related to a tax dispute between the school and the Sudanese authorities.
  • Canadian radio commentators have suggested that the Jyllands-Posten Danish cartoon controversy in 2005 may have increased the Muslim sensitivity to this issue.

Obama lessens US ban on offshore drilling

US President Barack Obama has announced that he will ease the country’s ban on offshore oil drilling, which has been in place since the 1980s.

According to the plan, offshore drilling would now be allowed in parts of the Atlantic, from Delaware down to 125 miles beyond the shoreline of Florida, in the eastern Gulf of Mexico.

The move, however, does have some restrictions; drilling further northeast or along the West Coast is still prohibited. Contracts in Bristol Bay, Alaska were also suggested, but were scrapped due to environmental concerns.

The president remarked that he decided the move was needed to lessen the country’s need for additional energy, adding that he had studied the issue for over a year. “This is not a decision that I’ve made lightly,” he said.

“We’re announcing the expansion of offshore oil and gas exploration but in ways that balance the need to harness domestic energy resources and the need to protect America’s natural resources,” Obama continued, speaking at Andrews Air Force Base in Maryland. “My administration will consider potential new areas for development in the mid and south Atlantic and the Gulf of Mexico.”

“Drilling alone can’t come close to meeting our long-term energy needs, and for the sake of our planet and our energy independence, we need to begin the transition to cleaner fuels now. I know that we can come together to pass comprehensive energy and climate legislation that’s going to foster new energy — new industries, create millions of new jobs, protect our planet, and help us become more energy independent.”

Obama said that the plan was partially intended to garner support from Republicans in Congress for a climate-change bill to lower greenhouse gas emissions, which has been languishing for months due to lack of support from Republicans.

Some environmental groups, however, condemned Obama’s move. Phil Radford, who is with the Greenpeace group, said that “[e]xpanding offshore drilling in areas that have been protected for decades threatens our oceans and the coastal communities that depend on them with devastating oil spills, more pollution and climate change.” Greenpeace also said that lifting the ban fuelled the US’ “addiction to oil”.

Republican leader for the House of Representatives John Boehner, meanwhile, said he agreed with lifting the ban in the Atlantic, but remarked that it “makes no sense” not to have lifted it in other areas as well. “Opening up areas off the Virginia coast to offshore production is a positive step, but keeping much of the Pacific Coast and Alaska, as well as the most promising resources off the Gulf of Mexico, under lock and key makes no sense at a time when gasoline prices are rising and Americans are asking ‘Where are the jobs?'”, he said.

“Today’s announcement is a step in the right direction, but a small one that leaves enormous amounts of American energy off limits,” said the Senate Minority leader, Republican Mitch McConnell.

According to the US Minerals Management Service, the eastern Gulf of Mexico and parts of the Atlantic south and east of the continent could contain up to 5.8 billion barrels of oil and 40.5 trillion cubic feet of gas. The West Coast, meanwhile, which remains off limits for drilling, contains 10.5 billion barrels of oil with 18 trillion cubic feet of gas.

Introduced by Alan Rosenberg, current President of the Screen Actors Guild, Grey’s Anatomy star Sandra Oh and Bobby, Happy Feet actor Elijah Wood announced nominees for “the Actors”.

The award ballots will be mailed to voters tomorrow. The Guild’s entire active membership is allowed to vote, before the January 26 deadline. It is the only award voted on solely by actors, and the only award given solely to actors.

The ceremonies are held two days later, on January 28. TNT and TBS will both air the program in the United States, at 8 p.m. ET/PT, 7 p.m. CT, and 6 p.m. MT. In Canada, CTV is expected to show the special.

A total of eleven funny men and women got “Outstanding Performance by a Actor in a Comedy Series” nominations.

For male actors, the list reads Alec Baldwin as Jack Donaghy in 30 Rock, Steve Carell as Michael Scott in The Office, Jason Lee as Earl Hickey in My Name is Earl, Jeremy Piven as Ari Gold in Entourage, and Tony Shalhoub as Adrian Monk in Monk.

The females given a nod were America Ferrera as Betty Suarez in Ugly Betty, Felicity Huffman as Lynette in Desperate Housewives, Julia Louis-Dreyfus as Christine Campbell in The New Adventures of Old Christine, Megan Mullally as Karen Walker in Will & Grace, Mary-Louise Parker as Nancy Botwin in Weeds, and Jaime Pressly as Joy in My Name is Earl.

Olivia Benson in Law & Order: Special Victims Unit, Kyra Sedgwick as Deputy Chief Brenda Johnson in The Closer, and Chandra Wilson as Dr. Miranda Bailey in Grey’s Anatomy.

Two nominations in the “Outstanding Performance by an Ensemble in a Drama Series” went to each ABC and HBO. The first got acknowledgement for Grey’s Anatomy and Boston Legal, while the series on the latter were The Sopranos and Deadwood. The FOX network’s series 24 also received a nomination.

Up for “Outstanding Performance by an Ensemble in a Comedy Series” are The Office on NBC, ABC’s Ugly Betty and Desperate Housewives, and two cable series, Showtime’s Weeds and HBO series Entourage.

Many of the series have writing and performances that could qualify them for either Drama or Comedy series, such as Boston Legal and Desperate Housewives.

The Sopranos was the only series to get three nominations; telefilm Broken Trail also received that many.

As with many television-related award shows over the last decade, HBO lead the pack in nominations, with 10. ABC and NBC received 8 each.

Bangladesh security tightened following Pilkhana massacre and Bashundhara City fire

Following the Pilkhana massacre which occurred February 25 and 26 leaving 74 dead and the inferno at the Bashundhara City shopping mall complex March 13 leaving seven dead, Prime Minister Sheikh Hasina said security measures are being tightened countrywide across Bangladesh.

Fire drills will be enacted at all key-point installations (KPI). Fire fighting systems will be examined by the fire brigade and the public works department (PWD) to ensure functionality. Security measures will be enhanced supplementing areas under private security such as at the Bashundhara City Complex.

The Fire Service and Civil Defence Department requires modernization and needs new equipment to fight fires past the sixth floor of buildings. The Fire Brigade says it needs turntable ladders, snorkels, foam-tenders, lighting units, emergency tenders, fireproof uniforms, and rescue ropes for fire fighting and rescue operations. Transportation to fires is also an issue due to narrow roads, low electrical wires and congestion.

The Bangladesh National Building Code requires fire fighting equipment installed in buildings over seven floors. This code is to be monitored by authorities to ensure compliance with the new guidelines and to make sure buildings are being maintained.

The Bashundhara City Complex opened Monday for shoppers two days after Friday’s blaze. A probe is underway to determine the cause of the fire and to assess structural damage.

Loss of life was minimized as the blaze broke out on a Friday, the beginning of the weekend in Bangladesh, so offices in the upper floors were empty. The lower eight floors are used for shopping and the upper floors are all Bashundhara Group offices.

The mall is valued at Tk 7.0 billion (US$100 million). It is not known if the complex is covered by fire insurance.

It is estimated that it will take over two years to rebuild the area damaged by flames which were burned down to a skeleton. Bashundhara City’s technical advisor, Latifur Rahman, estimated damages at Tk 2.0 billion (US$29m).

Only one television cameraman has been allowed in to film the burnt area. None of the 2,500 shops, cinemas or cafes were burnt by the inferno. The seventh and eighth floors still experience smoke damage, and there was water damage to merchandise.

A three member committee is currently investigating the cause of the fire which will consist of Iqbal Khan Chowdhury, joint secretary of the ministry, representatives of the police, IGP Noor Muhammad, and fire brigade, Director General Abu Nayeem Md Shahidullah. The committee is required to report within the week with their findings. The forensics department is also sifting through the burnt remains.

The Dhaka Chamber of Commerce and Industries has also formed a committee which has begun interviewing witnesses and recording their testimony alongside the government committee.

It has been discovered that 150 closed circuit cameras were not being used when the fire started. Another mystery is why the mall fire fighting system has been found unused.

“In the shopping mall there is an ultra-technology elevator which runs even without electricity but we have found that locked,” Iqbal Khan Chowdhury, joint secretary (Police) of the home ministry, said. “Why the fire burnt so fiercely is a matter to think. We have to see if there was any incendiary substance there. These matters seem to be mysterious.”

Mall management has been asked to submit substances and items which would have been in the upper floors when the fire started. The fire erupted on the 17th floor and spread quickly to the two floors above and engulfed the three floors below. The aerial ladders belonging to the Fire Service and Civil Defence reached as high as the 13th floor of the 21-storey building.

Videos have been sent to the United States (US) for examination to assist in determining the cause of the fire and to help in the damage assessment. Experts from the US are expected to arrive soon.

Firefighters were brought to the rooftop of the 20-storey tower by helicopter. The only fatality in this operation was Baki Billa, a firefighter of Bashundhara City firefighting department, who fell when climbing down a rope from a helicopter to the roof of the building. Three other firefighters made the transition safely. At this same time, the chief security officer was safely rescued by the Bangladesh Air Force helicopter, a Bell 212. Six security officers of the complex also lost their lives.

Should You Sell Structured Settlement Annuity Payments?

Annuitants wanting to sell structured settlement payments must first determine if this practice is allowed in the state where they reside. Approximately 34 states prohibit the sale or transfer of annuity payments. States which do allow the practice limit the number of annuity payments sold and require Annuitants to obtain court approval prior to the sale.

Annuitants choose to sell structured settlement annuities for many reasons. Some need a lump sum cash advance to fund college tuition, start a business, or pay off outstanding debts. Others want funds for investment purposes such as buying real estate or cash flow notes.

Courts typically frown on requests for selling annuities; particularly if structured settlements were awarded due to serious injury. Injury-based structured settlements are established to ensure Annuitants receive adequate funds to cover living expenses and ongoing medical expenses. Courts are not eager to allow Annuitants to cash-out future payments unless there is substantial proof the sale will positively impact the Annuitant’s life.

Structured settlements are also used to compensate jackpot lottery winners. When individuals win mega-millions they can opt for a lump sum cash payment or annuity payments. When lottery winners accept lump sum payments they receive considerably less money than winners who elect an extended payout. Courts are more open to authorizing the sale of structured settlements used for lottery payouts than those used for injury compensations.

Structured settlements are also used to distribute inheritance funds provided in an irrevocable life insurance trust (ILIT). Courts can swing either direction when Annuitants seek permission to sell inheritance funds. Much depends on how the ILIT was established. Courts respond more favorably when annuity payments are distributed annually vs. being distributed when Annuitants reach major milestones.

Regardless of the reason structured settlements were established, it is best for Annuitants to obtain legal counsel prior to seeking court approval.

Annuity payments are backed by life insurance companies. When Annuitants sell partial payments they must transfer payment rights to the funding source. Once court authorization is obtained, Annuitants must also obtain approval from the life insurance company.

Annuitants must provide the insurance company with contact information for the funding source, along with the number of payments to transfer. Life insurance companies are not required to approve transfers and are often unwilling to authorize the transfer of future annuities.

Annuity payments are sold to funding sources for a lump sum cash payment. Funding sources are generally private investors, investment companies, and cash advance providers. Some banks and credit unions provide cash for annuities, but the majority of financial institutions do not engage in this type of funding.

Funding sources do not offer full face value of annuities. Investors typically charge an upfront fee ranging between 20- and 30-percent of advanced funds. For example, an Annuitant receives $10,000 every three months and requires $100,000 in cash.

The Annuitant would need to transfer 12 to 13 payments to cover the full amount required, plus the funding source fees. The life insurance company would send payments to the funding source until the cash advance is repaid. Afterward, annuity payments revert back to the Annuitant.

The most common strategy for selling structured settlements is to sell partial payments. Courts rarely approve the sale of structured settlements in whole. The exception is for lottery winnings or if only a few years of payments remain.

The decision to sell structured settlement payments is a decision that should not be taken lightly. Annuitants should carefully weigh the pros and cons of selling future annuities. It is best to consult with a lawyer or tax accountant to determine if this is the best financial decision and to ensure proper protocol is followed.
